These Terms and Conditions ("Terms") govern the use of the website gtabathsolutions.ca (the "Website") and the services offered by Five Star Bath Solutions of GTA North ("Five Star", "we", "us", or "our").
1. Acceptance of Terms
By accessing or using the Website or by hiring Five Star for bathroom remodeling or conversion services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you are not authorized to use the Website or our services.
2.Use of Website
The Website is provided for informational purposes only. You may not use the Website for any illegal or unauthorized purpose. You agree not to:
- Interfere with or disrupt the Website or servers or networks connected to the Website.
- Use the Website to transmit any viruses, worms, Trojan horses, or other destructive code.
- Obtain or attempt to obtain unauthorized access to the Website or any portion thereof.
3.Services
3.1 Scope of Services
Five Star provides bathroom remodeling and conversion services in the GTA North region of Canada. The specific scope of services will be outlined in a separate written agreement for each project ("Project Agreement").
3.2 Estimates and Project Agreements
We will provide a written estimate outlining the scope of work, materials, and estimated costs before commencing any project. You will need to sign the Project Agreement before work begins.
3.3 Warranties
Five Star warrants all materials and workmanship for a defined period following completion of the project. This warranty does not cover normal wear and tear, misuse, or damage caused by the customer.
3.4 Payment Terms
Payment terms will be outlined in the Project Agreement. We typically require a deposit upfront, with the remaining balance due upon completion of the project.
3.5 Cancellations
In accordance with Ontario's Consumer Protection Act, you have the right to cancel this Project Agreement within 10 days of signing. If cancellation occurs within this 10-day period, no penalties will apply. If cancellation occurs after the 10-day period and work has commenced, you may be responsible for the cost of any materials purchased and labor performed up to the point of cancellation.
4.Limitation of Liability
Five Star shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to these Terms, the Website, or our services. Our total liability to you for any claim arising out of these Terms or the services provided will not exceed the amount you paid us for the project.
5.Intellectual Property
The Website and all content and materials on the Website, including trademarks, copyrights, and other intellectual property rights, are the property of Five Star or its licensors. You may not use any content or materials on the Website without our prior written consent.
6.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.
7.Entire Agreement
These Terms constitute the entire agreement between you and Five Star regarding the use of the Website and our services.
8.Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
9.Waiver
No waiver of any breach of these Terms by Five Star shall constitute a waiver of any other or subsequent breach.
